California Assembly Bill 349 – signed into law on September 4, 2015.
Assembly Bill 349 (AB 349) was signed into law by California Governor Brown on September 4, 2015. The law was passed as an emergency statute and takes effect immediately. The law amends California Civil Code §4735 by making any provision in the governing documents of a common interest development or its architectural or landscaping guidelines or policies that prohibit use of artificial turf or any other synthetic surface that resembles grass void and unenforceable. The new law also prohibits requirements that compel an owner of a separate interest to remove or reverse water-efficient landscaping measures that were installed in response to a declaration of a state of emergency, upon conclusion of the emergency.
